Henry County considered two commercial rezoning requests on January 5, 2022. Both requests were along state route 138 near Brown Road. The board unanimously denied both rezoning requests.
Both requests were located in commission district V. Before motioning to deny the requests, Commissioner Holmes said neither request reflected his vision for the state route 138 corridor. The applicants proposed a new gas station and auto sales business, respectively.
SR 138 at Brown Road
HSHA, LLC of Johns Creek, GA submitted the rezoning request for the corner property at SR 138 and Brown Road. The street address is 3818 North Henry Blvd. The property consists of 1.653 acres. It presently has a residential agricultural zoning. They applied for the C-1 (neighborhood commercial) zoning district. The C-1 district allows their proposed use for a new gas station.
The proposed gas station included a 3,500 square foot convenience store and five gas dispensers. The applicant also proposed an electric car charging station.
3860 North Henry Blvd
Likewise, land owners at 3860 North Henry Blvd submitted a commercial rezoning request. The applicant requested the C-3 (highway commercial) zoning district to allow used car sales.
The property has 0.621 acres. The owner planned to use the existing building as the office. There were no plans at this time for additional structures.
Since the board denied the rezoning requests, both properties keep their residential agricultural zoning. The land owners may apply for rezoning again in the future if they so choose.
